When Montgomery outlined the scheme for Jones, she "really didn't say nothing at all," Montgomery says, according to a letter his attorney sent White Plains Federal Judge Kenneth Karas.

"Her acquiescence was significant to Mr. Montgomery who understandably interpreted it as permission," attorney Timothy Heaphy writes.

Montgomery is also asking Karas to ignore his arrest earlier this month on charges of dealing 111 grams of heroin in his native Virginia.

I suppose his law dude is just doing what law dudes have to do. But I share EPelle's reaction to this story.

If it issue is sentencing for crime 1 when he has not been tried/convicted of crime 2 yet, ignoring crime 1 would be a normal request, I would think, since nothing other than the arrest is officially on the record, I suppose.

Part of his defence in the first case was that he was a squeaky-clean athlete who was decorated and well-known. That has turned out to be false.

Classic BS. But I guess they need to convince themselves that it's OK - it's the mindset that they use to justify to themselves doing the crime in the first place.
