Far as I know, neither USATF nor USADA has realeased ANY names, let alone the fifth one. They're observing due process. The names already out there were "leaks" not official "namings." Remember Bernard Lagat?

Due process?? I watched a movie the other night about the DC-area snipers! Wow, they were baaaad dudes! How inhumane of them to kill innocent people like that! Guilty guilty guilty! MURDERERS!! Oh wait, except for the fact that they *really are* innocent until proven guilty in a court of law, and the movie aired the night before their trial began.

So, where the hell is due process there? How come these guys are plastered across every television screen in America as "the DC Snipers" when their trial hasn't even started? What happened to due process for accused violators of the law?

Compare that to not releasing the names of some cheaters because of their "rights as Americans" until the magical second test has been done (and it takes three months to do it, for some reason -- thank goodness the British are so much more technologically advanced in the medical field).

Compare the difference between US criminal law and the rules/regulations governing sport, which include accepted international anti-doping procedures. One of these things is not like the other...

While you're at it, you may want to review in particular the process for the second test (which you seem to think is conducted by the governing body and not the independant labs). Ever try to arrange a convenient testing time where the athlete and/or their legal/scientific representative can be prepared and present, along with the other involved parties?

Exactly. So why does due process, as defined by American law / Bill of Rights, seem to hold only for Americans in international athletics?

The national federations are permitted to release the names of the A positives if they so choose. So explain the ruling in which the USATF decided that they can't release names until after the B test. As I recall, it stems from rules that aren't that much different than criminal cases.

I've checked with the alphabet soup people, and I'm pretty sure this is how everybody stands at the moment:

Kelli White and Chris Phillips have been officially charged with Modafinil positives from the World Championships. Both these cases are pending arbitration. Should they be found guilty, they will lose that meet, nothing more.

Dwain Chambers has been officially charged with a THG positive from early in August. He is also eligible for arbitration. THG is a 2-year-ban substance, but the IAAF has been making public statements about using the reduced-sentence provision for people who come clean (n pun intended) and provide details on the chain of supply.

Kevin Toth, Regina Jacobs and John McEwen have been reported in newspapers to be THG positives. No governing body has issued any sanction against any of them.

Calvin Harrison was listed in a newspaper story as being a Modafinil positive. He has not been charged by any body, but did say to a newspaper that he had indeed taken it. Since he has a cold-medication violation from his Junior days almost a decade ago, this would apparently be construed as a second strike and result in a 2-year ban.

i THINK that's the sum total of all that can be said with certainty at this point.
